
Age discrimination
Much has been written on this subject but just a month into the new legislation, naturally, no developing case precedents are emerging just yet.
What has emerged is an increasing number of commentators/providers/legal firms prepared to voice a view on what is and what is not likely to be acceptable within the new regulations.
There has been more comment on risk benefit issues than healthcare issues but greater balance between the two subjects is beginning to emerge. On a Healthcare point, at one stage, there was thought to be difficulty over the issue of continuing to apply age-rated premiums to employees covered for Health Insurance. It is now widely thought that this will be an acceptable practice due to there being real ‘risk’ differences between younger and older people.
It is not practical here to highlight all the potential issues and challenges that the new legislation brings to Health and Risk Benefit-related matters, but we are well placed to assist you with both our own views and the wider views of various commentators.
